Last updated:

This page contains the Terms of Service and the Privacy Policy that govern your use of the Flotip mobile application and related services (together, the "Service"). Please read both carefully. By creating an account or using the Service you agree to be bound by these documents. If you do not agree, do not use the Service.

Terms of Service

1. Who we are

The Service is operated by the publisher of Flotip ("Flotip", "we", "us", "our"). Contact information for legal notices is provided at the end of this page.

2. Eligibility

You must be at least 13 years old (or the minimum age required by the laws of your country, whichever is higher) to create an account and use the Service. By using the Service you represent that you meet this age requirement and that you have the legal capacity to enter into a binding agreement. Where required by local law, users below the age of majority must obtain consent from a parent or legal guardian.

3. Your account

To access certain features you must register for an account. You agree to provide accurate information, keep it up to date, and maintain the confidentiality of your credentials. You are solely responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. User Content

The Service allows you to create, upload, store, and share photographs, captions, comments, messages, and other content (collectively, "User Content"). You retain all rights you hold in your User Content. You are solely responsible for your User Content and for the consequences of posting it.

5. License you grant to Flotip

By submitting User Content to the Service, you grant Flotip a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (e.g. resize, transcode, format), create derivative works from, communicate, publish, publicly perform, publicly display, and distribute that User Content, solely for the purposes of operating, developing, providing, promoting, and improving the Service and researching and developing new ones. This license ends when you delete the relevant User Content from the Service, except to the extent that the User Content has been shared with others and they have not deleted it, and subject to a reasonable backup-retention window.

You also grant other users of the Service a license to access your User Content through the Service and to use, reproduce, distribute, display, and perform that User Content as permitted by the functionality of the Service (for example, viewing your posts in the feed, saving them in their library, or forwarding them in a conversation).

6. Acceptable use

You agree not to use the Service to:

  • upload content that is illegal, defamatory, obscene, sexually explicit (including any sexual content involving minors), violent, threatening, harassing, hateful, or otherwise inappropriate;
  • infringe any third-party intellectual property, privacy, publicity, or other right;
  • impersonate any person or entity, or misrepresent your affiliation with a person or entity;
  • collect, harvest, or scrape personal data from other users;
  • send unsolicited advertising or spam, or operate automated accounts ("bots") not authorized by us;
  • introduce viruses, malware, or any code intended to disrupt or damage the Service;
  • circumvent any access control, rate-limiting, or security measure;
  • reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by applicable law.

7. Reporting and moderation

We may, but are not obliged to, monitor User Content. We reserve the right (but not the obligation) to review, remove, or disable access to any User Content that we, in our sole discretion, consider to be in breach of these Terms or harmful to the Service or its users. You can report content or users that you believe violate these Terms by contacting us at the address listed below.

8. Intellectual property of Flotip

The Service itself, including its software, design, trademarks, logos, and the "Flotip" name, is owned by Flotip and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes, subject to these Terms. No other rights are granted by implication.

9. Third-party services

The Service relies on third-party providers for authentication, storage, and analytics (including, without limitation, Google Firebase). Your use of those features is also subject to the terms and privacy policies of the relevant third party. We are not responsible for the practices of third-party services.

10. Termination

You may stop using the Service at any time and delete your account from within the application. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that you have violated these Terms, that your account is inactive, or that we are required to do so by law. Sections that by their nature should survive termination (e.g., licenses already granted, indemnification, limitation of liability, governing law) will survive.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Flotip, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service. Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, and (b) one hundred euros (€100). Some jurisdictions do not allow these limitations; where this is the case, the limitations apply only to the extent permitted.

13. Indemnification

You agree to indemnify, defend, and hold harmless Flotip, its affiliates, officers, employees, and agents from and against any claim, demand, loss, damage, liability, cost, or expense (including reasonable legal fees) arising out of (i) your User Content; (ii) your use of the Service; or (iii) your violation of these Terms or of any third-party right.

14. Changes to these Terms

We may update these Terms from time to time. If we make a material change we will provide reasonable notice (e.g., via in-app notification or by updating the "Last updated" date above). Your continued use of the Service after a change becomes effective constitutes acceptance of the revised Terms. If you do not agree to the change, you must stop using the Service.

15. Governing law and disputes

These Terms are governed by the laws of Italy, without regard to its conflict-of-laws principles. The courts of Milan, Italy shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory consumer-protection laws of your country of residence provide otherwise.

16. Miscellaneous

These Terms constitute the entire agreement between you and Flotip with respect to the Service. If any provision is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer your rights under these Terms without our prior written consent; we may assign them freely.

Privacy Policy

This Privacy Policy explains what personal data we collect, how we use it, with whom we share it, and the rights you have under applicable data-protection law (in particular, the EU General Data Protection Regulation — "GDPR" — for users located in the European Economic Area). We are the controller of your personal data unless otherwise stated.

1. Data we collect

  • Account data: first name, last name, email address, date of birth, password (stored only as a salted hash by our authentication provider), profile photo (optional), and short bio (optional).
  • Content you create: photos, captions, the source URL associated with a tip, items saved to your library, likes, bookmarks, follows, and chat messages.
  • Usage data: technical information about how you use the Service, including device model, operating-system version, application version, language, IP address, crash logs, and approximate diagnostic information.
  • Cookies and similar technologies on the Flotip website (this site): essential cookies are used to deliver the site; we do not currently use advertising cookies.

2. How we use your data

  • to create and maintain your account and authenticate you;
  • to provide the core features of the Service (feed, library, follow, chat, search);
  • to keep the Service safe, prevent abuse, and enforce our Terms;
  • to communicate with you about your account and important changes to the Service;
  • to comply with legal obligations and respond to lawful requests;
  • where you have consented, to send you optional product updates — you can withdraw your consent at any time.

3. Legal bases (GDPR)

For users located in the EEA, we rely on the following legal bases:

  • Performance of a contract — to provide the Service you signed up for;
  • Legitimate interests — to keep the Service secure, prevent fraud, and improve our product;
  • Legal obligation — where we must process data to comply with the law;
  • Consent — for activities that require it (e.g., optional marketing emails). Consent can be withdrawn at any time.

4. Sharing your data

We share personal data only as described below:

  • With other users of the Service: your username, profile photo, bio, posts, and any messages you send are visible to the recipients you choose (e.g., other followers, the counterpart of a chat).
  • With service providers who process data on our behalf, including: Google Firebase (Authentication, Cloud Firestore, Cloud Storage) — see Firebase privacy. These providers are bound by data-processing agreements that require them to protect your data.
  • For legal reasons: we may disclose data when required by law, court order, or public-authority request, or to protect the safety of our users or the public.
  • In a corporate transaction: if Flotip is involved in a merger, acquisition, or asset sale, your data may be transferred as part of that transaction. We will notify you before your personal data is transferred and becomes subject to a different privacy policy.

We do not sell your personal data and we do not use it for third-party advertising.

5. International transfers

Some of our service providers (notably Google Firebase) may store and process your data outside the European Economic Area, including in the United States. Where this is the case, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses or equivalent legal mechanisms.

6. Data retention

We retain your personal data for as long as your account is active and for a reasonable period afterwards to comply with legal obligations, resolve disputes, and enforce our agreements. When you delete your account, we delete or irreversibly anonymize your personal data within a commercially reasonable time, except where retention is required by law or where the data has been shared publicly (in which case copies may persist with other users).

7. Security

We use industry-standard technical and organizational measures to protect your data, including encryption in transit (HTTPS), access controls, and secure authentication. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Your rights

Depending on where you live you may have the right to:

  • access the personal data we hold about you;
  • request that we correct inaccurate data;
  • request that we delete your data ("right to be forgotten");
  • request that we restrict or stop processing your data;
  • object to our processing based on legitimate interests;
  • receive your data in a portable, machine-readable format;
  • withdraw any consent you previously gave;
  • lodge a complaint with a supervisory authority — for users in Italy, the Garante per la Protezione dei Dati Personali (garanteprivacy.it).

To exercise any of these rights, contact us at the address below. We will respond within the timeframes required by applicable law (typically thirty days for GDPR).

9. Children

The Service is not directed to children under the age of 13 (or the minimum age set by your jurisdiction, if higher). We do not knowingly collect personal data from children below this age. If you believe we have collected personal data from a child, please contact us so that we can delete it.

10. Cookies on this website

The Flotip website uses only essential cookies that are strictly necessary to deliver the page (for example, to remember your consent choice and to balance load between servers). We do not use analytics or advertising cookies on this website.

11. Changes to this Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page reflects the most recent change. Where the change is material we will provide additional notice (e.g., in-app banner or email).
