Terms of Service
1. Introduction
Welcome to Flotip. These Terms of Service ("Terms") govern your access to and use of the Flotip mobile application, websites, and related services (collectively, the "Service"), provided by the Flotip team. By creating an account, downloading the app, or otherwise using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please do not use Flotip.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of the Service after such changes means you accept the updated Terms.
2. Eligibility
You must be at least 16 years old to create an account or use Flotip. By using the Service, you represent and warrant that you meet this minimum age requirement. If we discover that an account has been created by a person under 16, we will suspend and delete the account.
You are also responsible for ensuring that your use of Flotip complies with the laws of the jurisdiction in which you reside.
3. Account Responsibilities
To use most features of Flotip you need a registered account. You agree to:
- provide accurate, current, and complete information during registration;
- keep your password confidential and not share your account with anyone;
- be responsible for all activity that occurs under your account;
- notify us promptly at support@flotip.com if you suspect any unauthorized use of your account.
We are not liable for any loss or damage arising from your failure to keep your credentials secure.
4. User Content
Flotip lets you create and share content such as posts, screenshots, library items, and messages ("User Content"). You retain ownership of your User Content. By submitting User Content to Flotip, you grant Flotip a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, and distribute your User Content solely for the purpose of operating, providing, and improving the Service.
This license ends when you delete your User Content or your account, except where the content has been shared with others who have not deleted it, or where we are required to retain it for legal or technical reasons (such as backups).
You are responsible for the User Content you publish and represent that you own or have the necessary rights to share it.
5. Prohibited Content and Conduct
You agree not to upload, post, transmit, or otherwise make available any content that:
- is sexually explicit, pornographic, or otherwise harmful to minors;
- promotes hatred, harassment, threats, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic;
- is illegal, fraudulent, defamatory, or violates the rights (including intellectual property rights) of others;
- contains malware, spam, phishing links, or attempts to compromise the security of the Service.
You also agree not to scrape, reverse-engineer, or interfere with the normal operation of Flotip, and not to use the Service to impersonate another person or entity.
6. Termination
You may stop using Flotip at any time and delete your account from the in-app Settings. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe that you have violated these Terms, that termination is necessary to protect Flotip or its users, or that you are using the Service in a way that may expose us to legal liability.
Upon termination, your right to access the Service ceases immediately. Sections relating to User Content licenses (where applicable), disclaimers, limitation of liability, and governing law will survive termination.
7. Disclaimers
Flotip is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, error-free, or free of viruses or other harmful components.
We do not guarantee the accuracy, completeness, or reliability of any User Content or other information available through the Service.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Flotip, its affiliates, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us, if any, to use the Service in the twelve months preceding the claim, or (b) twenty euros (€20).
9. Governing Law
These Terms are governed by and construed in accordance with the laws of Italy, without regard to conflict-of-laws principles. The courts of Italy will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Service, except where mandatory consumer-protection laws of your country of residence apply.
